1. Purpose
This policy outlines how PixMuse handles intellectual property rights, copyright ownership of generated content, and the process for reporting and resolving copyright infringement claims.
2. Scope
This policy applies to all content generated, uploaded, or shared through the PixMuse platform, and to all users, copyright holders, and third parties who interact with PixMuse content.
3. Respect for Intellectual Property
PixMuse respects the intellectual property rights of others and expects its users to do the same. The platform is committed to responding to legitimate copyright complaints in a timely manner.
4. Ownership of Generated Content
User-Generated Images
- Users retain rights to images generated from their prompts, subject to these terms
- Users are responsible for ensuring their use of generated content does not infringe on existing copyrights
Platform Licensing
- PixMuse retains a non-exclusive license to use generated content for platform operation, maintenance, and improvement
- This license does not transfer ownership of user-generated content to PixMuse
Limitations
- AI-generated images may unintentionally resemble existing copyrighted works due to the nature of machine learning
- PixMuse does not guarantee that generated content is free from potential copyright claims
- Users bear responsibility for verifying the originality of content before commercial or public use
5. User Responsibility
Users must:
- Not intentionally use prompts designed to reproduce copyrighted works
- Not upload copyrighted material to the platform without authorization
- Respect the intellectual property rights of artists, photographers, and other creators
- Accept responsibility for copyright claims arising from their use of generated content
6. Infringement Reporting
If you believe that content on the PixMuse platform infringes your copyright, you may submit a complaint including:
- Identification of the copyrighted work you claim has been infringed
- Description of the allegedly infringing content and its location on the platform
- Contact information of the complainant (name, address, email, phone number)
- Statement of good faith that the use is not authorized by the copyright owner
- Statement of accuracy that the information provided is accurate and that you are authorized to act on behalf of the copyright owner
- Signature (physical or electronic) of the copyright owner or authorized representative
Where to Submit
Copyright complaints may be submitted through PixMuse's official contact channels.
7. Content Removal (DMCA-Style Takedown)
Upon receipt of a valid copyright complaint:
- PixMuse will review the complaint for completeness and validity
- If valid, the allegedly infringing content will be removed or access disabled
- The account holder will be notified of the complaint and removal
- Repeated infringement may result in account termination
8. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification including:
- Identification of the content that was removed
- Statement under penalty of perjury that the content was removed by mistake or misidentification
- Consent to jurisdiction of the appropriate court
- Contact information and signature
PixMuse will review counter-notifications and may restore removed content if appropriate.
9. Repeat Infringers
PixMuse maintains a policy of terminating accounts of users who are determined to be repeat copyright infringers.
10. Review and Updates
This policy is reviewed periodically to address evolving intellectual property regulations and platform needs. Updates are communicated through the platform.
PixMuse policies are developed in accordance with internationally recognized standards including ISO 9001:2015 Quality Management Systems, ISO/IEC 27001 Information Security practices, ISO/IEC 40500:2012 Web Accessibility Guidelines (WCAG 2.0), and applicable provisions of the Information Technology Act, 2000 (India).
